49 Welnu, de omstreden Deense bepaling, die het de werkgever veroorlooft geheel naar eigen inzicht te beslissen of hij al dan niet een zwangere werkneemster in dienst wil houden, uitsluitend op grond van het feit dat zij zich in die toestand bevindt - de bepaling verlangt immers niet, dat de vrouw arbeidsongeschikt is verklaard -, kan niet gedekt zijn door de uitzondering van artikel 2, lid 3, van richtlijn 76/207, omdat zij in het geheel niet de bescherming van de zwangere vrouw beoogt, doch de mogelijkheid biedt haar tijdelijk haar arbeid te ontnemen, enkel omdat de werkgever zo beslist.
49 However, the Danish provision in question, which leaves it to the employer's discretion whether he can continue to give employment to a pregnant employee merely because she is in that situation - as it is not necessary for her to be found unfit for work - cannot be covered by Article 2(3) of Directive 76/207 because, instead of protecting pregnant women, what it does is to make it possible to leave them temporarily unemployed merely by their employer's decision.EurLex-2 EurLex-2
