79 De verwijzende rechter moet eveneens nagaan of de bevoegde instanties de verwezenlijking van deze doelstelling naar behoren hebben verzoend met de door het recht van Unie gestelde eisen, en, in het bijzonder, met de mogelijkheid voor de uit andere lidstaten afkomstige studenten om toegang te hebben tot het hoger onderwijs, welke mogelijkheid de essentie is van het beginsel van vrij verkeer van studenten (zie in die zin arrest Commissie/Oostenrijk, reeds aangehaald, punt 70).
79 Equally, it is for the referring court to examine whether the competent authorities have reconciled, in an appropriate way, the attainment of that objective with the requirements of European Union law and, in particular, with the opportunity for students coming from other Member States to gain access to higher education, an opportunity which constitutes the very essence of the principle of freedom of movement for students (see, to that effect, Commission v Austria, paragraph 70).EurLex-2 EurLex-2
