16 Den hänskjutande domstolen har påtalat att EU-domstolen hittills endast har yttrat sig i allmänna ordalag genom att ange att ”[a]rtikel 16 a‐d i förordning nr 110/2008 rör ett antal situationer då en varas marknadsföring åtföljs av en uttrycklig eller underförstådd hänvisning till en geografisk beteckning under sådana förhållanden [som innebär] att omsättningskretsen kan missledas eller åtminstone i sina tankar göra associationer till varans ursprung, eller som gör att den berörda näringsidkaren på ett orättmätigt sätt kan snylta på ifrågavarande geografiska betecknings renommé” (dom av den 14 juli 2011, Bureau national interprofessionnel du Cognac, C‐4/10 och C‐27/10, EU:C:2011:484, punkt 46).
