1. Im Rahmen eines Rechtsstreits zwischen einer Versicherungsgesellschaft, die in die Rechte des Geschädigten, dem sie eine Entschädigung gewährt hat, eingetreten ist, auf der einen und dem Staat auf der anderen Seite ist das nationale Gericht verpflichtet, die Vorschriften des innerstaatlichen Rechts unangewendet zu lassen, nach denen die Kraftfahrzeug-Haftpflichtversicherung die Haftung für Personenschäden von Einzelpersonen nicht deckt, die in einem Teil eines Kraftfahrzeugs mitfahren, der mit Sitzgelegenheiten für Mitfahrer weder konstruiert noch gebaut wurde, deren Unvereinbarkeit mit Art. 1 der Dritten Richtlinie 90/232/EWG des Rates vom 14. Mai 1990 zur Angleichung der Rechtsvorschriften der Mitgliedstaaten über die Kraftfahrzeug-Haftpflichtversicherung sich aus dem Urteil vom 19. April 2007, Farrell (C‐356/05, EU:C:2007:229), ergibt.
