2 Abs. 2 lit a iVm Art. 6 Abs 1 RL 2000/78/EG (4) — so auszulegen, dass sie einer nationalen Regelung entgegenstehen, die bei Kündigungs-/Entlassungsanfechtungsklagen wegen Diskriminierungen u.a. Aufgrund des Geschlechts keine Sozial- oder Interessenabwägung, sondern nur eine Beweiswürdigung darüber zulassen, ob die Diskriminierung aufgrund des Geschlechts überwiegendes Motiv für die Kündigung/Entlassung war, oder ein anderer, vom Arbeitgeber substantiiert zu behauptender anderer Grund überwog?
