31 It follows from that continuity in terms of functions between the departments of OHIM that, in the review of decisions taken by the departments of OHIM hearing the application at first instance that the Boards of Appeal must undertake, the Boards of Appeal are required to base their decision on all the matters of fact and of law which the parties concerned introduced either in the proceedings before the department which heard the application at first instance or in the appeal (see KLEENCARE, paragraph 32; Case T-57/03 SPAG v OHIM – Dann and Backer (HOOLIGAN) [2005] ECR II-287, paragraph 18; and Case T-275/03 Focus Magazin Verlag v OHIM – ECI Telecom (Hi-FOCuS) [2005] ECR II-0000, paragraph 37).
31 Az OHIM fórumai közötti funkcionális folyamatosság elvéből következik, hogy az OHIM első fokon döntő fórumai által hozott határozatok tekintetében lefolytatandó felülvizsgálat keretében a fellebbezési tanácsoknak a felek által mind az első fokon döntő fórum előtti, mind pedig a fellebbezési eljárásban előterjesztett valamennyi ténybeli és jogi elemre kell a határozataikat alapítaniuk (az Elsőfokú Bíróság fent hivatkozott KLEENCARE‐ítéletének 32. pontja; a T‐57/03. sz., SPAG kontra OHIM – Dann et Backer [HOOLIGAN] ügyben 2005. február 1‐jén hozott ítélet [EBHT 2005., II‐287. o.] 18. pontja és a T‐275/03. sz., Focus Magazin Verlag kontra OHIM – ECI Telecom [Hi‐FOCuS) ügyben 2005. november 9‐én hozott ítélet [EBHT 2005., II‐4727. o.] 37. pontja).EurLex-2 EurLex-2
