Secondly, it wishes to ascertain whether national rules are compatible with Articles 86 and 90(1), read in conjunction, where they not only confer, de jure or de facto, a monopoly in respect of the provision of mooring services at ports but also permit the individual grantees of such concessions, at ports of such size and importance for intra-Community trade as Genoa and La Spezia, effectively to charge tariffs that are out of proportion to the actual cost of providing the mooring services in question, and, moreover, that vary from port to port.
