40 La continuité fonctionnelle, évoquée dans la jurisprudence du Tribunal [arrêts du Tribunal du 23 septembre 2003, Henkel/OHMI – LHS (UK) (KLEENCARE), T‐308/01, Rec. p. II‐3253, points 25 et 26 ; du 1er février 2005, SPAG/OHMI – Dann et Backer (HOOLIGAN), T‐57/03, Rec. p. II‐287, point 18, et du 10 juillet 2006, La Baronia de Turis/OHMI − Baron Philippe de Rothschild (LA BARONNIE), T‐323/03, non encore publié au Recueil, points 57 et 58], ne saurait, en tout état de cause, justifier la présentation d’une telle requête pour la première fois devant la chambre de recours, dès lors qu’elle n’implique nullement un examen par la chambre de recours d’une affaire différente de celle soumise à la division d’opposition, à savoir une affaire dont la portée aurait été élargie par l’ajout de la question préalable de l’usage sérieux de la marque antérieure.
