1 Met dit beroep verzoekt de Europese Commissie het Hof vast te stellen dat de Republiek Malta is tekortgeschoten in de nakoming van de verplichtingen die op haar rusten krachtens artikel 5, onder a) en e), en artikel 8, lid 1, juncto bijlage IV, onder a), van richtlijn 2009/147/EG van het Europees Parlement en de Raad van 30 november 2009 inzake het behoud van de vogelstand (PB 2010, L 20, blz. 7), gelezen in samenhang met artikel 9, lid 1, van deze richtlijn, doordat zij een afwijkende regeling heeft vastgesteld op grond waarvan zeven soorten wilde vinkachtigen (de vink Fringilla coelebs, de kneu Carduelis cannabina, de putter Carduelis carduelis, de groenling Carduelis chloris, de appelvink Coccothraustes coccothraustes, de Europese kanarie Serinus serinus en de sijs Carduelis spinus) levend mogen worden gevangen.
