It thus ruled that, contrary to what had been held in that judgment, disputes involving the civil service under Article 236 EC and Articles 90 and 91 of the Staff Regulations, including those in which compensation is sought for damage caused to an official or agent, are governed by particular and special rules that differ from those stemming from the general principles on the non-contractual liability of the Union under Article 235 EC and the second paragraph of Article 288 EC (see, to that effect, the judgment of 12 June 2002 in Case T-187/01 Mellone v Commission, paragraph 74, and judgment of 14 October 2004 in Case T-1/02 Polinsky v Court of Justice, paragraph 47).
