129 First, in its action before the General Court, EnBW made no attempt to show that certain individual documents disclosure of which was sought were not covered by that presumption but simply criticised the Commission, in essence, for refusing access to a set of documents in its file, on the basis of general and abstract considerations and suppositions, on the ground that, as the purpose of Regulation No 1049/2001 is to give the fullest possible effect to the right of public access to documents held by the institutions, the Commission was required to grant it such access, unless it were able to show specifically in what way certain individual documents were covered by the exceptions provided for in Article 4(2) and (3) of that regulation.
129 Enerzijds heeft EnBW in haar beroep bij het Gerecht geen poging ondernomen om aan te tonen dat bepaalde specifieke documenten waarvan de openbaarmaking werd gevraagd, niet onder dat vermoeden vielen, maar heeft zij, zakelijk weergegeven, de Commissie alleen verweten de toegang tot een samenstel van documenten uit haar dossier te hebben geweigerd op basis van algemene en abstracte overwegingen en veronderstellingen. Zij voerde aan dat, aangezien verordening nr. 1049/2001 erop gericht was het recht van toegang van het publiek tot documenten maximaal zijn beslag te geven, de Commissie verplicht was haar toegang te geven tot die documenten indien zij niet kon aantonen in welk opzicht bepaalde specifieke documenten in concreto onder de uitzonderingen van artikel 4, leden 2 en 3, van die verordening vielen.EurLex-2 EurLex-2
