195 The dominant position referred to in Article 2 of Regulation No 4064/89 is concerned with a situation where one or more undertakings wield economic power which would enable them to prevent effective competition from being maintained in the relevant market by giving them the opportunity to act to a considerable extent independently of their competitors, their customers and, ultimately, of consumers (Case T-102/96 Gencor v Commission [1999] ECR II-753, paragraph 200; see also, to that effect, Case 85/76 Hoffman-La Roche v Commission [1979] ECR 461, paragraph 38).
195 Med dominerande ställning enligt artikel 2 i förordning nr 4064/89 förstås att ett eller flera företag har sådan ekonomisk makt att de kan förhindra bibehållandet av effektiv konkurrens på den ifrågavarande marknaden på grund av att de har möjlighet att i betydande omfattning uppträda utan att ta hänsyn till sina konkurrenter och kunder och, slutligen, till konsumenterna (förstainstansrättens dom av den 25 mars 1999 i mål T-102/96, Gencor mot kommissionen, REG 1999, s.
