53 Zoals de advocaat-generaal in punt 81 van zijn conclusie heeft vastgesteld, staat, wat de ingezeten belastingplichtigen betreft, het enkele feit dat deze laatsten inkomsten verwerven uit een op het grondgebied van het Koninkrijk België gelegen onroerend goed, ten aanzien waarvan deze lidstaat zijn heffingsbevoegdheid uitoefent, niet eraan in de weg dat het Koninkrijk der Nederlanden deze inkomsten uit onroerend goed opneemt in de heffingsgrondslag voor de inkomstenbelasting die deze belastingplichtigen moeten betalen.
53 As the Advocate General observes in point 81 of his Opinion, in the case of resident taxpayers, the mere fact that they receive income from a property located in Belgium in respect of which that State exercises its fiscal jurisdiction does not preclude the Kingdom of the Netherlands from including such property income in the taxable basis of income tax to be paid by those taxpayers.

53 Even if the Commission could, under the procedure laid down in Article 226 EC, have taken action against the Kingdom of the Netherlands on the basis of other provisions of Community law in respect of the system for issuing new fishing licences, as the Advocate General observed in point 45 of her Opinion, it is common ground that the breach of such provisions does not constitute the subject-matter of the failure to fulfil obligations complained of (see Case C‐6/04 Commission v United Kingdom [2005] ECR I‐9017, paragraphs 58 to 60, and Case C‐225/04 Commission v France [2006] ECR I‐0000, paragraph 24).
