38 Aangezien de voorwaarden voor de ontvankelijkheid van een beroep van openbare orde zijn en de door het Comitato „Venezia vuole vivere” in de zaken T‐265/00, T‐267/00, T‐274/00–T‐276/00, T‐281/00, T‐287/00 en T‐296/00 ingestelde beroepen dezelfde partijen betreffen en strekken tot nietigverklaring van dezelfde beschikking, moet het Gerecht ambtshalve nagaan of de ontvankelijkheid van sommige van deze beroepen niet afstuit op aanhangigheid (arresten Hof van 26 mei 1971, Bode/Commissie, 45/70 en 49/70, Jurispr. blz. 465, punt 11, en 17 mei 1973, Perinciolo/Raad, 58/72 en 75/72, Jurispr. blz. 511, punt 5).
38 Since the conditions of admissibility of an action are an issue of public policy, and since the actions in Cases T-265/00, T-267/00, T-274/00 to T-276/00, T-281/00, T-287/00 and T-296/00 brought by the Comitato ‘Venezia vuole vivere’ involve the same parties and seek the annulment of the same decision, it is for the Court to determine of its own motion whether some of those actions are rendered inadmissible by reason of lis pendens (Joined Cases 45/70 and 49/70 Bode v Commission [1971] ECR 465, paragraph 11, and Joined Cases 58/72 and 75/72 Perinciolo v Council [1973] ECR 511, paragraph 5).EurLex-2 EurLex-2
