53 Aangaande in de tweede plaats het criterium van afhankelijkheid van een instelling ten opzichte van de overheid, dat in de rechtspraak van het Hof is ontwikkeld met betrekking tot de drie varianten van artikel 1, sub b, tweede alinea, derde streepje, van richtlijn 92/50 (zie in die zin arrest van 15 januari 1998, Mannesmann Anlagenbau Austria e.a., C‐44/96, Jurispr. blz. I‐73, punt 20), verwijst de verwijzende rechter naar de hiervóór vermelde opvatting die wordt verdedigd door een stroming in de Duitse rechtspraak en rechtsleer, volgens welke deze afhankelijkheid impliceert dat de overheid een concrete invloed kan uitoefenen op de verschillende procedures voor de plaatsing van opdrachten.
53 As regards, secondly, the criterion of the dependence of a body on the public authorities, developed in the case-law of the Court as regards the three conditions to be found in the third indent of the second paragraph of Article 1(b) of Directive 92/50 (see, to that effect, Case C‐44/96 Mannesmann Anlagenbau Austria and Others [1998] ECR I‐73, paragraph 20), the referring court refers to the above mentioned approach of one school of thought in German case-law and academic writing, to the effect that dependence implies that the public authorities are able to have actual influence on the awarding of various contracts.EurLex-2 EurLex-2
