I syfte att stärka varumärkesskyddet och bekämpa varumärkesförfalskning effektivare och i linje med unionens internationella skyldigheter inom ramen för Världshandelsorganisationen (WTO), särskilt artikel V i allmänna tull- och handelsavtalet (Gatt) om transiteringsfrihet och, vad gäller generiska läkemedel, den förklaring om Trips-avtalet och folkhälsa som antogs av WTO:s ministerkonferens i Doha den 14 november 2001, bör innehavaren av ett EU-varumärke ha rätt att hindra tredje man från att i näringsverksamhet föra in varor i unionen utan att dessa övergått till fri omsättning där, om dessa varor kommer från tredjeländer och utan tillstånd har försetts med ett varumärke som är identiskt eller väsentligen identiskt med det EU-varumärke som registrerats för sådana varor.
In order to strengthen trade mark protection and combat counterfeiting more effectively, and in line with international obligations of the Union under the framework of the World Trade Organisation (WTO), in particular Article V of the General Agreement on Tariffs and Trade (GATT) on freedom of transit and, as regards generic medicines, the ‘Declaration on the TRIPS Agreement and public health’ adopted by the Doha WTO Ministerial Conference on 14 November 2001, the proprietor of an EU trade mark should be entitled to prevent third parties from bringing goods, in the course of trade, into the Union without being released for free circulation there, where such goods come from third countries and bear without authorisation a trade mark which is identical or essentially identical with the EU trade mark registered in respect of such goods.EurLex-2 EurLex-2
