Предвид изложените по-горе съображения предлагам Съдът да отговори на третия и четвъртия въпрос, поставен от запитващата юрисдикция, че член 2, параграф 1 от Директива 98/59 във връзка с член 2, параграф 4 от същата директива следва да се тълкува в смисъл, че при група от предприятия задължението за консултиране с представителите на работниците възниква от момента, когато работодателят или предприятието, което го контролира, възнамерява или предвижда извършването на колективни уволнения.
In the light of the foregoing considerations, I propose that the Court’s answer to the third and fourth questions raised by the referring court should be that Article 2(1) of Directive 98/59, read in conjunction with Article 2(4) of that directive, is to be interpreted as meaning that, in the case of a group of undertakings, the obligation to consult the workers’ representatives arises when either the employer or the undertaking controlling the employer plans or foresees collective redundancies.EurLex-2 EurLex-2
