Mit seiner ersten und seiner zweiten Frage, die zusammen zu prüfen sind, möchte das vorlegende Gericht im Wesentlichen wissen, ob Art. 2 Buchst. c der Rahmenrichtlinie dahin auszulegen ist, dass ein internetbasierter E‐Mail-Dienst, der keinen Internetzugang vermittelt, wie der von Google erbrachte Dienst Gmail unter Berücksichtigung der informationstechnischen Verarbeitung, die der Anbieter dieses Dienstes über seine E‐Mail-Server erbringt, indem er den E‐Mail-Adressen die IP-Adressen der Endgeräte zuordnet und die Datenpakete, in die diese E‐Mails zerlegt sind, in das offene Internet einspeist oder aus diesem empfängt, einen Dienst darstellt, der ganz oder überwiegend in der Übertragung von Signalen über elektronische Kommunikationsnetze besteht.
26 By its first and second questions, which it is appropriate to examine together, the referring court asks, in essence, whether Article 2 (c) of the Framework Directive must be interpreted as meaning that a web-based email service which does not itself provide internet access, such as the Gmail service provided by Google, constitutes a service which consists wholly or mainly in the conveyance of signals on electronic communications networks, having regard to the electronic processing which the provider of that service supplies via its email servers, on the one hand, by assigning to the email addresses the IP addresses of the corresponding terminal devices and, on the other hand, by uploading to or receiving from the open internet the data packets relating to the emails.Eurlex2019 Eurlex2019
