As the Advocate General notes in point 52 of his Opinion, the fact that a beneficiary under an insurance contract can avail himself of that clause against the insurer is not liable to cause him harm but, on the contrary, by adding a further forum to those provided for by the Brussels Convention in relation to insurance matters, is conducive to greater protection of the economically weakest party.
Domstolen prövade dock inte huruvida klausulen kunde åberopas av försäkringsgivaren mot denne tredjeman.
