53 Ai sensi dell’articolo 51, paragrafo 1, del regolamento n. 207/2009, il titolare del marchio comunitario è dichiarato decaduto dai suoi diritti se il marchio non ha formato oggetto di un uso effettivo per un periodo ininterrotto di cinque anni (...), se, per l’attività o l’inattività del suo titolare, il marchio è divenuto denominazione abituale nel commercio di un prodotto o di un servizio per il quale è registrato (...), o se, in seguito all’uso che ne viene fatto dal titolare del marchio o col suo consenso (...) il marchio è tale da poter indurre in errore il pubblico (...).
53 According to Article 51(1) of Regulation No 207/2009, the rights of the proprietor of the Community trade mark are to be declared to be revoked if, within a continuous period of five years, it was not put to genuine use ..., if, in consequence of acts or inactivity of the proprietor, the trade mark has become the common name in the trade for a product or service in respect of which it is registered ... or if, in consequence of the use made of it by the proprietor of the trade mark or with his consent, the trade mark is liable to mislead the public ...EurLex-2 EurLex-2
