Met betrekking tot de overeenkomst over woningen wordt in het besluit tot inleiding van de procedure opgemerkt dat de prijs die Bizkailur zou betalen voor de 1 500 woningen niet marktconform leek te zijn, aangezien de begunstigde in zijn eigen bedrijfsplan had berekend dat de gemiddelde door Bizkailur te betalen prijs 2 012,19 EUR/m2 zou bedragen, terwijl de marktconforme prijs op gemiddeld 1 762,6 EUR/m2 was gechat.
