Artikel 67 EEG-Verdrag en artikel 1 van richtlijn 88/361/EEG van de Raad van 24 juni 1988 voor de uitvoering van artikel 67 van het Verdrag [artikel ingetrokken bij het Verdrag van Amsterdam], verzetten zich niet tegen een regeling van een lidstaat, als die welke in het hoofdgeding aan de orde is, die voor de vennootschapsbelasting en in het kader van regels ter vermijding van dubbele belasting de aftrek verbiedt van de in andere lidstaten van de Europese Unie verschuldigde belasting over inkomsten die aldaar zijn verkregen en waarop die belasting wordt geheven, wanneer de belasting weliswaar verschuldigd is, maar niet behoeft te worden betaald op grond van een vrijstelling, belastingkrediet of enig ander fiscaal voordeel, voor zover die regeling niet discriminerend is vergeleken met de behandeling waaraan de in die lidstaat ontvangen rente wordt onderworpen, hetgeen de verwijzende rechter dient na te gaan.
Article 67 of the EEC Treaty and Article 1 of Council Directive 88/361/EEC of 24 June 1988 for the implementation of Article 67 of the Treaty (article repealed by the Treaty of Amsterdam) do not preclude national rules of a Member State, such as those at issue in the main proceedings, which, in the context of corporation tax and within the framework of provisions for the avoidance of double taxation, prohibit the deduction of amounts of tax due in other Member States of the European Union on income subject to corporation tax and obtained in their territory where those amounts, though due, are not paid by virtue of an exemption, a credit or any other tax benefit, in so far as those rules are not discriminatory as compared with the treatment applied to interest obtained in that Member State, it being for the national court to establish whether that is the case.EurLex-2 EurLex-2
