Met andere woorden, zodra buiten twijfel staat dat de litigieuze documenten zijn opgesteld voor een concrete gerechtelijke procedure en deel uitmaken van het dossier in een procedure die nog aanhangig is, kan geen sprake zijn van onwettige vervanging van motivering, omdat de Commissie geen beoordelingsvrijheid heeft, maar verplicht is de toegang tot die documenten te weigeren; derhalve kan niet worden staande gehouden dat een extra theoretische beoordeling of verklaring met betrekking tot de fundering, stelselmatige uitlegging en het doel van de toegepaste bepaling, een onwettige toeëigening van een dergelijke beoordelingsbevoegdheid achteraf zou kunnen rechtvaardigen.
In other words, since there is no doubt that the documents in question were drafted for specific court proceedings and constitute information in the file in those proceedings which are still pending, there can be no question of the grounds being improperly replaced because the Commission has no discretion in the matter, but is obliged to refuse access to those documents; it therefore cannot be maintained that an assessment or clarification which is, moreover, theoretical, as to the basis, systematic interpretation and purpose of the provision to be applied can improperly provide any a posteriori justification for the exercise of such discretionary power.EurLex-2 EurLex-2
