„Artikel 12, lid 1, sub c, van richtlijn 69/335/EEG van de Raad van 17 juli 1969 betreffende de indirecte belastingen op het bijeenbrengen van kapitaal, zoals gewijzigd bij richtlijn 85/303/EEG van de Raad van 10 juni 1985, moet aldus worden uitgelegd dat het niet in de weg staat aan de heffing van een belasting, zoals de Finse overdrachtsbelasting, wanneer effecten als inbreng worden overgedragen aan een kapitaalvennootschap die als tegenprestatie eigen nieuw uitgegeven aandelen uitreikt, aangezien een dergelijke belasting krachtens artikel 12, lid 1, sub a, van deze richtlijn is toegestaan.”
‘Article 12(1)(c) of Council Directive 69/335/EEC of 17 July 1969 concerning indirect taxes on the raising of capital, as amended by Council Directive 85/303/EEC of 10 June 1985, is to be interpreted as meaning that it does not preclude the charging of a duty, such as the Finnish capital transfer tax, where securities are transferred as a contribution to a capital company which gives new shares of its own in return, since such a duty is permitted under Article 12(1)(a) of that directive’.EurLex-2 EurLex-2
