In de context van de onderhavige zaak en gelet op de informatie waarover het Hof beschikt, zou elke andere conclusie naar mijn mening gevaarlijk dicht in de buurt komen van de suggestie dat nationale rechters ingevolge het Unierecht volledige functionele immuniteit dienen te genieten, of er nagenoeg op neerkomen dat nationale instanties en procedures feitelijk door het Hof moeten worden „herontworpen”, in die zin dat bepaalde bevoegdheden worden weggehaald bij de ene soort instantie (de civiele rechter) en worden overgeheveld naar een andere soort instantie (tuchtraden of andere organen binnen de hoge raad voor de magistratuur), zonder dat er een specifieke reden daarvoor is, afgezien dan van een vooropgezette mening over de wijze waarop aan de rechterlijke verantwoordingsplicht invulling moet worden gegeven.
In the context of the present case and the information provided to this Court in these proceedings, any other conclusion would, in my view, come dangerously close either to suggesting that, as a matter of EU law, there must be full functional immunity for national judges, or having this Court effectively engage in redesigning national institutions and procedures by taking certain competences from one institution (civil courts) and effectively shifting it to another (disciplinary panels or other bodies within the SCM), without having any specific reason to do so apart from a preconceived vision of a certain structure of judicial accountability.EuroParl2021 EuroParl2021
