I en situation där en militär atomdriven ubåt repareras och där det har konstaterats att kärnenergin är av militärt ursprung, skulle det innebära att bestämmelserna rörande hälsoskydd i Euroatomfördraget, bland annat artikel 31 EA, gavs ett annat tillämpningsområde än övriga bestämmelser i detta fördrag för det fall det godtogs att den skyldighet att informera den befolkning som troligen kommer att beröras i händelse av en nödsituation som medför risk för strålning om de hälsoskyddsåtgärder som skulle komma att tillämpas, en skyldighet som följer av artikel 5 i direktivet, icke desto mindre är tillämplig på medlemsstaterna.
In the case of the repair of a nuclear-powered submarine, where it is common ground that the source of the nuclear energy is of military origin, to accept that the obligation under Article 5 of the directive to inform the public who might be affected in the event of a radiological emergency about health protection measures that would apply is incumbent none the less on Member States would amount to recognising that the provisions of the EAEC Treaty concerning health and safety, in particular Article 31 EA, are different in scope from the other provisions of that Treaty.EurLex-2 EurLex-2
