Der Rat dagegen hat hierzu schriftlich im wesentlichen geltend gemacht, die Versorgung der pharmazeutischen Industrie sei nicht das Endziel der Regelung, sondern nur ein Mittel zur Gewährleistung des Gesundheitsschutzes durch ausreichende Arzneimittelherstellung ( d . h . zur Erreichung eines Zieles, das von Artikel 39 nicht erfasst werde ); in der mündlichen Verhandlung hat er ausserdem betont, es habe bei der Festlegung der Regelung zur Versorgung der pharmazeutischen Industrie auf einen ausreichenden Schutz der öffentlichen Gesundheit geachtet werden müssen ( wofür Artikel 100 des Vertrages in Betracht komme ), und er hat auch Zweifel daran geäussert, ob - bei Berücksichtigung des Wortsinnes und der Bedeutung des Begriffes in anderen gemeinschaftsrechtlichen Akten - als Verbraucher im Sinne des Artikels 39 auch Industrieunternehmen angesehen werden können .
The Council, on the other hand, contended in its pleadings essentially that assuring the availability of supplies to the pharmaceutical industry was not the ultimate objective of the directive, but only a means to ensure the protection of health through adequate production of pharmaceutical preparations ( that is to say, the attainment of an objective that is not included in Article 39 ); at the hearing the Council also emphasized that when rules were laid down on supplies for the pharmaceutical industry, it was necessary to ensure that public health was adequately protected ( in which respect Article 100 of the Treaty was relevant ) and it also expressed doubts whether, taking into account the lexical meaning and significance of the term in other Community measures, industrial undertakings could be regarded as consumers within the meaning of Article 39 .EurLex-2 EurLex-2
