3 In court, Mr Geffroy, who is the defendant in the criminal proceedings, pleaded in his defence, as to the lack of labelling in French: that the Coca-Cola drinks had been bought in Great Britain; that this was a well-known product; that the consumer could not consider himself inconvenienced by labelling in English which could be easily understood by anybody; that there was a sign giving a translation of those labels, but that a customer had probably made it fall to the bottom of the display unit; and that the suppliers of Merrydown ciders and Red Raw beers had made a mistake by not providing stickers in French for attachment to those drinks, as they had been requested to do.
3 Under afhøringen af Yannick Geffroy, der er tiltalt i straffesagen, anførte han til sit forsvar vedrørende den manglende mærkning på fransk, at coca cola-flaskerne var indkøbt i Storbritannien, at der var tale om en almindeligt kendt vare, at forbrugeren ikke kunne føle sig generet af en mærkning på engelsk, som er let forståelig for alle og enhver, at der fandtes et skilt med en oversættelse af disse etiketter, men at en kunde sandsynligvis havde væltet skiltet ned i bunden af udstillingsdisken, samt at leverandørerne af Merry Down cider og af Red Raw øl havde begået en fejl ved ikke at medsende de klistermærker på fransk, som skulle påklæbes disse drikkevarer, hvilket de ellers var blevet anmodet om.EurLex-2 EurLex-2
