If other types of tortious act were to be extrapolated from this, (67) that approach could, in my view, result in a court having jurisdiction, on the basis of the place where the damage occurred, where, as in the main proceedings in this case, that damage stems from the fact that the suspect product ‘may’ be made available to consumers in the Member State where that court has its seat and such an act is penalised in respect of civil liability under the lex fori.
