Se totesi myös valituksenalaisen tuomion 86 kohdassa, että kun otetaan huomioon päätöksen 94/262 2 artiklan 6 kohta, jonka mukaan oikeusasiamiehelle esitetyt kantelut eivät keskeytä oikeudenkäyntiin tai hallinnolliseen menettelyyn liittyvän valitusajan kulumista, ja yhteisöjen tuomioistuimen edellä mainitussa asiassa Internationaler Hilfsfonds vastaan komissio antama määräys, näistä eroista ei päinvastoin voinut seurata, että kun oikeusasiamies toteaa hallinnollisen epäkohdan, tämä toteamus muodostaa uuden seikan niin, että kantaja, joka ei ole nostanut kannetta alkuperäisestä päätöksestä, voisi onnistua kiertämään mainitun määräajan.
It also held, in paragraph 86 of the judgment under appeal, that, in the light of Article 2(6) of Decision 94/262, according to which complaints submitted to the Ombudsman are not to affect time-limits for appeals in administrative or judicial proceedings, and the order of the Court of Justice in Internationaler Hilfsfonds v Commission, cited above, those differences could not mean, by converse implication, that a finding of an instance of maladministration by the Ombudsman constitutes a new factor and that an appellant which has not brought court proceedings against an initial decision may therefore circumvent the relevant time-limits.EurLex-2 EurLex-2
