Tuttavia, il criterio desunto dalla Corte dalla sua giurisprudenza pregressa e descritto nella sentenza di cui alla causa C‐57/16 P, ClientEarth/Commissione, che, innegabilmente, non era disponibile al momento della pronuncia della sentenza impugnata, non consiste nel fatto che le informazioni siano nuove, bensì se sia ragionevolmente prevedibile che l’accesso a tali informazioni possa arrecare pregiudizio agli interessi commerciali delle parti che le hanno raccolte.
