De Commissie hanteert weliswaar het criterium dat genoemd begrip in strikte zin dient te worden opgevat, maar het is niet minder waar dat de buitengewone omstandigheden en de daaruit voortvloeiende verzachtende maatregel voortkomen uit het feit dat de Spaanse regering, overeenkomstig de in het openbaar beleden opvatting van de Commissie dat de belastingen op brandstoffen niet moeten worden verlaagd, om niet de argumenten van de Organisatie van Olie-exporterende Landen (OPEC) over te nemen, heeft besloten om genoemde belastingen te handhaven en tegelijkertijd een compensatiemogelijkheid te zoeken, gezien de buitensporige prijsstijging die het voortbestaan van de bedrijven ernstig bedreigt en heeft geleid tot stakingen, ernstige ordeverstoringen en schaarste van energieproducten en levensmiddelen.
While accepting that the Commission is right to interpret the notion restrictively, this does not detract from the fact that the exceptional occurrences and the resulting mitigating measure both came into being because the Spanish Government decided to follow the public line taken by the Commission and not to give in to the Organisation of Petroleum Exporting Countries (OPEC) by cutting fuel taxes, deciding instead to leave the taxes unchanged and to find another way of compensating for the excessive rise in prices that was seriously threatening the survival of farms, provoking strikes, public disturbances and energy and food shortages.EurLex-2 EurLex-2
