29 Het Bundesfinanzhof verwees evenwel naar het arrest van 13 december 1989, Genius Holding (C-342/87, Jurispr. blz. 4227, punt 18), volgens hetwelk het, om de toepassing van het beginsel van de neutraliteit van de belasting te garanderen, aan de lidstaten staat, in hun nationale recht de mogelijkheid op te nemen om, wanneer de opsteller van de factuur te goeder trouw blijkt te zijn, alle ten onrechte gefactureerde belasting te herzien, alsook naar een arrest van het Bundesgerichtshof van 23 november 1995, IX ZR 225/94 (Neue Juristische Wochenschrift 1996, blz. 842), waarin deze rechterlijke instantie heeft geoordeeld, dat aangezien § 14, lid 3, UStG niet in de mogelijkheid van herziening voorziet, het arrest Genius Holding (reeds aangehaald) moest worden gevolgd door krachtens § 227 AO kwijtschelding van de belasting te verlenen.
29 The Bundesfinanzhof referred, however, to paragraph 18 of the judgment in Case C-342/87 Genius Holding v Staatssecretaris van Financiën [1989] ECR 4227 which states that, in order to ensure the application of the principle of neutrality of VAT, it is for the Member States to provide in their internal legal systems for the possibility of correcting any tax improperly invoiced where the issuer of the invoice shows that he acted in good faith. The Bundesfinanzhof also referred to a judgment of the Bundesgerichtshof (Federal Court) of 23 November 1995, IX ZR 225/94 (Neue Juristische Wochenschrift 1996, p. 842), in which that court held that, taking into account the fact that Paragraph 14(3) of the UStG did not provide for any possibility of adjustment, the way to comply with Genius Holding was by a waiver of tax under Paragraph 227 of the AO.EurLex-2 EurLex-2
