22 Deze zaken vonden dus hun oorsprong in de vraag of een samengesteld merk, bestaande uit een woordcombinatie naast de afkorting ervan, kon worden ingeschreven gelet op artikel 3, lid 1, onder b) en c), van richtlijn 2008/95 en betroffen niet de beoordeling, zoals in casu, van mogelijk verwarringsgevaar in de zin van artikel 4, lid 1, onder b), van deze richtlijn tussen een ouder merk, bestaande uit een lettercombinatie, en een jonger merk, dat deze lettercombinatie overneemt met nevenschikking van een woordcombinatie,.
22 The question underlying the abovementioned cases therefore consisted in determining whether a composite mark consisting of a word combination attached to its acronym was capable of being registered in the light of Article 3(1)(b) and (c) of Directive 2008/95 and not in assessing, as is the case here, whether there may be a likelihood of confusion, within the meaning of Article 4(1)(b) of that directive, between an earlier mark consisting of a sequence of letters and a later mark, which reproduces that sequence juxtaposed with a word combination.EurLex-2 EurLex-2
