52 In de tweede plaats moet in het bijzonder worden onderzocht of het recht om te worden gehoord, zoals dat van toepassing is in het kader van richtlijn 2008/115, en met name artikel 6 daarvan, voor een illegaal verblijvende derdelander tegen wie een terugkeerbesluit moet worden uitgevaardigd, het recht omvat om alle gegevens te onderzoeken die met betrekking tot zijn verblijfsrecht tegen hem worden aangevoerd en waarop de bevoegde nationale autoriteit voornemens is dat besluit te baseren, hetgeen veronderstelt dat de nationale overheid hem deze vooraf verstrekt en hem voldoende bedenktijd toekent om zich op het gehoor voor te bereiden, alsmede het recht om zich te laten bijstaan door de raadsman van zijn keuze.
52 It is necessary, secondly, to examine, in particular, whether the right to be heard, as it applies in the context of Directive 2008/115 and, in particular, Article 6 of that directive, includes the right of an illegally staying third-country national with respect to whom a return decision is to be issued to analyse all the evidence relied on against him which serves to justify that decision by the competent national authority, which presupposes that the national authorities disclose that evidence to him in advance and grant him a period for reflection which is adequate for his preparation to be heard, and the right to have recourse to the legal representation of his choice when he is heard.EurLex-2 EurLex-2
