12 Abs. 2 Buchst. a der Richtlinie 2014/17 dahin auszulegen ist, dass er einer nationalen Regelung entgegensteht, nach der der Kreditgeber vom Kreditnehmer verlangen kann, dass er alle seine Einkünfte aus nicht selbständiger Arbeit oder diesen gleichgestellte Bezüge unabhängig von der Höhe, den Fälligkeiten und der Laufzeit des Kredits per Dauerauftrag auf ein bei diesem Kreditgeber eröffnetes Zahlungskonto fließen lässt, sind nach ständiger Rechtsprechung des Gerichtshofs nicht nur der Wortlaut dieses Artikels, sondern auch sein Zusammenhang und das Ziel zu berücksichtigen, das mit der Regelung, zu der er gehört, verfolgt wird (vgl. in diesem Sinne Urteil vom 26. Mai 2016, Envirotec Denmark, C‐550/14, EU:C:2016:354, Rn. 27 und die dort angeführte Rechtsprechung).
49 As regards whether, in the first place, Article 12(2)(a) of Directive 2014/17 must be interpreted as precluding national legislation under which a lender may require a borrower to deposit all his or her salary or similar income on a payment account opened with that lender, irrespective of the amount, maturities and duration of the loan, it is important, in accordance with the settled case-law of the Court, to take account not only of the terms of that article but also of its context and the objective pursued by the legislation of which it forms part (see, to that effect, judgment of 26 May 2016, Envirotec Denmark, C‐550/14, EU:C:2016:354, paragraph 27 and the case-law cited).EuroParl2021 EuroParl2021
