As I pointed out at the beginning, that secondary provision of Community law is intended to allow the Federal Republic of Germany to retain domestic measures in SGB VI which enable ethnic German residents of the eastern territories of the former German Reich which do not form part of the territory of the present Federal Republic of Germany who are recognised as expellees within the meaning of Paragraph 1 of the BVFG to derive claims to the payment of an old-age pension.
