16 Also, by judgment of 12 November 1998 in Case C-102/96 Commission v Germany [1998] ECR I-6871, the Court held that the Federal Republic of Germany had failed to fulfil its obligations under Articles 5(1)(o) and 6(1)(b) of Directive 64/433 and under Articles 5(1), 7 and 8 of Directive 89/662 by imposing the obligation of marking the carcases of uncastrated male pigs and subjecting them to heat treatment whenever the meat, regardless of carcase weight, had an androstenone content of more than 0.5 μg/g, as shown by Professor Claus's modified enzyme immunoassay, and by regarding the meat as giving off a pronounced sexual odour and consequently unfit for human consumption if the threshold of 0.5 μg/g of androstenone was exceeded.
16 Yhteisöjen tuomioistuin on lisäksi asiassa C-102/96, komissio vastaan Saksa, 12.11.1998 antamassaan tuomiossa (Kok., s. I-6871) todennut, että Saksan liittotasavalta ei ollut noudattanut direktiivin 64/433 5 artiklan 1 kohdan o alakohdan ja 6 artiklan 1 kohdan b alakohdan sekä direktiivin 89/662 5 artiklan 1 kohdan ja 7 ja 8 artiklan mukaisia velvoitteitaan, koska se oli yhtäältä edellyttänyt, että jos professori Clausin modifioidun immunoentsyymikokeen perusteella lihaan todetaan kerääntyneen yli 0,5 μg/g androstenonia, kastroimattomien karjujen teurasruhot on merkittävä ja lämpökäsiteltävä eläinten painosta huolimatta, ja koska se oli katsonut, että jos 0,5 μg/g androstenonin raja-arvo ylitetään, lihassa on voimakas sukupuolihaju ja se on siten ihmisravinnoksi kelpaamatonta.EurLex-2 EurLex-2
