Ráadásul még ha el is fogadjuk, hogy a bírságok általános szintje a közigazgatási eljárás alatt meg is nőtt, elegendő arra emlékeztetni, hogy az a tény, hogy a Bizottság a múltban bizonyos típusú jogsértésekre bizonyos mértékű bírságokat alkalmazott, nem fosztja meg a Bizottságot attól a lehetőségtől, hogy a 17. rendeletben meghatározott korlátok között megemelje ezt a mértéket, amennyiben az a versenypolitika végrehajtásának biztosítása érdekében szükségesnek tűnik; éppen ellenkezőleg, a közösségi versenyszabályok hatékony alkalmazása megkívánja, hogy a Bizottság a bírságok mértékét bármikor e politika igényeihez igazíthassa (a fenti 273. pontban hivatkozott Musique Diffusion française és társai kontra Bizottság ügyben hozott ítélet 109. pontja és a fenti 90. pontban hivatkozott Dansk Rørindustri kontra Bizottság ügyben 2005. június 28‐án hozott ítélet 169. pontja).
Even if it is accepted that the general level of fines has increased during the period of the administrative procedure, it is sufficient to recall that the fact that the Commission, in the past, imposed fines of a certain level for certain types of infringement does not mean that it is estopped from raising that level within the limits indicated in Regulation No 17 if that is necessary to ensure the implementation of Community competition policy. On the contrary, the proper application of the Community competition rules requires that the Commission may at any time adjust the level of fines to the needs of that policy (Musique diffusion française and Others v Commission, paragraph 273 above, paragraph 109, and judgment of the Court of Justice in Dansk Rørindustri and Others v Commission, paragraph 90 above, paragraph 169).EurLex-2 EurLex-2
