10 Verzoeksters, aan de ene kant Philips Lighting Poland S.A. (hierna: „Philips Poland”), een vennootschap naar Pools recht die in haar bedrijf te Piła (Polen) geïntegreerde elektronische compacte fluorescentielampen (hierna: „CFL-i’s”) produceert en ten tijde van de feiten aanzienlijke hoeveelheden CFL-i’s invoerde uit China met het oog op doorverkoop in de Europese Unie, en aan de andere kant Philips Lighting BV (hierna: „Philips”), een vennootschap naar Nederlands recht die onderdelen voor CFL-i’s produceert te Roosendaal (Nederland) en onderzoeks- en ontwikkelingsactiviteiten verricht op het vlak van CFL-i’s, zijn volledig in handen van Koninklijke Philips Electronics NV, een vennootschap naar Nederlands recht.

Philips Poland is a company incorporated according to Polish law which produces integrated electronic compact fluorescent lamps (‘CFL-i’) at its site at Piła (Poland), and at the material time it imported significant quantities of CFL-i from China for resale in the European Union. Philips is a company incorporated according to Netherlands law which produces component parts for CFL-i in Roosendaal (Netherlands) and carries on research and development in the area of CFL-i.
