In het arrest Ladbroke Racing(75) en, meer recentelijk, in het arrest Stardust(76) heeft het Hof uitdrukkelijk verklaard dat het begrip staatsmiddelen in de zin van artikel 87, lid 1, EG „alle geldelijke middelen omvat die de openbare sector daadwerkelijk kan gebruiken om ondernemingen te steunen, ongeacht of deze middelen al dan niet permanent deel uitmaken van het vermogen van die sector”.
In its judgment in France v LadbrokeRacing and Commission (75) and, more recently, in its judgment in France v Commission, (76) the Court explicitly confirmed that the concept of State resources within the meaning of Article 87(1) EC ‘covers all the financial means by which the public sector may actually support undertakings, irrespective of whether or not those means are permanent assets of the public sector’.EurLex-2 EurLex-2
