47 Om te beginnen moet eraan worden herinnerd, dat de Commissie over een aanzienlijke beoordelingsvrijheid beschikt ten aanzien van de elementen die zij in aanmerking neemt bij een beslissing over de gunning van een uitgeschreven opdracht, en dat het Gerecht zich dient te beperken tot de toetsing of de procedure‐ en motiveringsvoorschriften in acht zijn genomen, of de feiten juist zijn vastgesteld, en of er geen sprake is van een kennelijke beoordelingsfout of misbruik van bevoegdheid (arresten Gerecht van 24 februari 2000, ADT Projekt/Commissie, T‐145/98, Jurispr. blz. II‐387, punt 147, en 26 februari 2002, Esedra/Commissie, T‐169/00, Jurispr. blz. II‐609, punt 95).
47 As a preliminary point, it should be recalled that the Commission enjoys a broad margin of assessment with regard to the factors to be taken into account for the purpose of deciding to award a contract following an invitation to tender, and that review by the Court is limited to checking compliance with the procedural rules and the duty to give reasons, the correctness of the facts found and that there is no manifest error of assessment or misuse of powers (Case T-145/98 ADT Projekt v Commission [2000] ECR II-387, paragraph 147, and Case T‐169/00 Esedra v Commission [2002] ECR II‐609, paragraph 95).EurLex-2 EurLex-2
