Zoals in punt 94 hierboven in herinnering is gebracht, blijkt uit de rechtspraak immers dat de verplichting van de instellingen tot vertrouwelijke behandeling van onder het zakengeheim vallende informatie, de andere betrokken partijen, in het bijzonder de exporteurs, niet de procedurele waarborgen mag ontnemen waarin artikel 20 van de basisverordening voorziet, en de rechten die deze partijen op grond van die bepalingen zijn genieten, niet mag uithollen (zie, in die zin, arresten Timex/Raad en Commissie, punt 94 supra, EU:C:1985:119, punt 29, en Zhejiang Harmonic Hardware Products/Raad, punt 94 supra, EU:T:2011:639, punt 59).
As is recalled in paragraph 94 above, it follows from the case-law that the institutions’ obligation to ensure the confidential treatment of information covered by business secrecy cannot deprive the other parties concerned, exporters in particular, of the procedural safeguards laid down by Article 20 of the basic regulation, or deprive the rights that they enjoy under those provisions of their substance (see, to that effect, the judgments in Timex v Council and Commission, cited in paragraph 94 above, EU:C:1985:119, paragraph 29, and Zhejiang Harmonic Hardware Products v Council, cited in paragraph 94 above, EU:T:2011:639, paragraph 59).EurLex-2 EurLex-2
