Mot bakgrund av vad ovan anförts föreslår jag att domstolen besvarar den tredje och den fjärde frågan enligt följande. Artikel 2.1 i direktiv 98/59, jämförd med artikel 2.4 i detsamma, ska tolkas så att, i en koncern, skyldigheten att överlägga med arbetstagarrepresentanterna uppstår när antingen arbetsgivaren eller det företag som kontrollerar arbetsgivaren planerar eller förutser att vidta kollektiva uppsägningar.
In the light of the foregoing considerations, I propose that the Court’s answer to the third and fourth questions raised by the referring court should be that Article 2(1) of Directive 98/59, read in conjunction with Article 2(4) of that directive, is to be interpreted as meaning that, in the case of a group of undertakings, the obligation to consult the workers’ representatives arises when either the employer or the undertaking controlling the employer plans or foresees collective redundancies.EurLex-2 EurLex-2
