In the light of the foregoing considerations, I propose that the Court’s answer to the third and fourth questions raised by the referring court should be that Article 2(1) of Directive 98/59, read in conjunction with Article 2(4) of that directive, is to be interpreted as meaning that, in the case of a group of undertakings, the obligation to consult the workers’ representatives arises when either the employer or the undertaking controlling the employer plans or foresees collective redundancies.
A fenti megfontolásokra tekintettel azt javaslom a Bíróságnak, hogy a kérdést előterjesztő bíróság harmadik és negyedik kérdésére azt a választ adja, hogy a 98/59 irányelv 2. cikkének (1) bekezdését az irányelv 2. cikkének (4) bekezdésével összefüggésben úgy kell értelmezni, hogy vállalatcsoport esetén a munkavállalók képviselőivel való konzultáció megkezdésére vonatkozó kötelezettség akkor jön létre, amikor akár a munkáltató, akár a munkáltatót ellenőrző vállalkozás csoportos létszámcsökkentések végrehajtását tervezi vagy helyezi kilátásba .EurLex-2 EurLex-2
