While I am tempted to explain at length the development of the case-law, composed of a substantial line of judgments, on the interpretation of Article 3(1) of Directive 2001/29, it does not seem to me to be necessary to repeat the analysis of the expression ‘communication to the public’ or of the two individual elements of that expression: the ‘act of communication’ of a work and the ‘public’ to which it is directed.
