45 Zoals de Commissie in haar schriftelijke opmerkingen terecht betoogt, kan het feit dat de parallelimporteur het merk niet aanbrengt op de nieuwe buitenverpakking (debranding), dan wel dat hij daarop zijn eigen logo of stijl op aanbrengt, of een „‚huis’-opmaak”, dan wel een opmaak die gebruikt wordt voor een aantal verschillende producten (cobranding), net als het feit dat hij hetzij een extra etiket op een dusdanige wijze aanbrengt dat een van de merken van de merkhouder geheel of gedeeltelijk aan het oog wordt onttrokken, hetzij op dat extra etiket niet vermeldt dat het betrokken merk toebehoort aan de merkhouder, hetzij de naam van de parallelimporteur in hoofdletters drukt, in beginsel de goede naam van het merk aantasten.
45 As the Commission correctly argues in its written observations, the fact that a parallel importer does not affix the trade mark to the new exterior carton (‘de-branding’) or applies either his own logo or a house-style or get-up or a get-up used for a number of different products (‘co-branding’), or positions the additional label so as wholly or partially to obscure the proprietor’s trade mark, or fails to state on the additional label that the trade mark in question belongs to the proprietor, or prints the name of the parallel importer in capital letters is, in principle, liable to damage the trade mark’s reputation.EurLex-2 EurLex-2
