Immers, niet alleen toont het feit dat een onderneming een prijsafspraak niet nakomt, niet aan dat er geen sprake is van een inbreuk op het mededingingsrecht van de Unie (zie in die zin arrest Gerecht van 30 april 2009, CD-Contact Data/Commissie, T‐18/03, Jurispr. blz. II‐1021, EU:T:2009:132, punt 67 en aldaar aangehaalde rechtspraak), maar bovendien blijkt uit de uiteenzetting in het vorige punt juist dat de e‐mail van 9.57 uur met het prijzenoverzicht van Chiquita betrekking had op de prijsvoornemens van Pacific en dat in de e‐mail van 11.24 uur precies wordt uitgelegd waarom de werkelijke prijzen afweken van die voornemens.
The mere fact that an undertaking does not act on a collusion on prices is not capable of showing that there was no infringement of EU competition law (see, to that effect, Case T‐18/03 CD-Contact Data v Commission [2009] ECR II‐1021, paragraph 67 and the case-law cited) and, moreover, it can be seen from the foregoing paragraph that the e-mail of 9:57 a.m., which included the table of Chiquita’s prices, concerned Pacific’s price intentions and that the e-mail of 11:24 a.m. explains precisely why the real price deviated from those intentions.EurLex-2 EurLex-2
