166 Het vraagstuk van de kwalificatie van de nieuwe maatregelen ten gunste van NOA dient derhalve te worden onderscheiden van dat van de terugvordering van steun, dat is onderzocht in bijvoorbeeld het arrest Duitsland/Commissie, reeds aangehaald (punten 71, 87 en 88), waarin het Hof heeft geoordeeld dat het enkele feit dat een recent opgerichte dochteronderneming de activiteiten van de in staat van vereffening verkerende moedervennootschap voortzet door het huren van de bedrijfsruimte van deze laatste, terwijl de Commissie beweerde geen informatie te hebben ontvangen die haar in staat stelde te beoordelen of de huurprijzen in overeenstemming waren met de situatie op de markt, nog niet aantoont dat de huurder had geprofiteerd van het concurrentievoordeel uit de steun die vóór de oprichting van de huurder was verleend aan de verhuurder.
166 The question of the characterisation of the new measures in favour of NOA must therefore be distinguished from the question, relating to recovery of aid, examined, for example, in paragraphs 71, 87 and 88 of the judgment in Case C‐277/00 Germany v Commission, in which the Court of Justice held that the mere fact that a newly formed subsidiary had, through leasing the latter’s premises, carried on the activities of its parent which had been placed in insolvent liquidation, and, although the Commission maintained that it had not obtained information enabling it to assess whether the rents were consistent with market conditions, cannot lead to the conclusion that the lessee enjoyed the competitive advantage linked to the aid granted to the lessor before the lessee’s formation.EurLex-2 EurLex-2
