Uit het door de Commissie aangevoerde bewijs, dat verzoeksters overigens niet hebben betwist, blijkt namelijk dat verzoeksters in het kader van dat geding inderdaad hebben betoogd dat het door Matrix geproduceerde citalopram inbreuk maakte op het octrooi inzake kristallisatie, maar dat betrof wederom hun eigen subjectieve beoordeling, aangezien die stelling nooit door de in die zaak aangezochte rechter is bevestigd. Verzoeksters hadden er immers de voorkeur aan gegeven om met Lagap te schikken om een nederlaag te voorkomen die, in hun eigen woorden, een „vernedering” zou zijn geweest en „tegen hen zou zijn gebruikt in ander jurisdicties” (overweging 160 van het bestreden besluit).
It can be seen from the evidence put forward by the Commission, which, moreover, is not called into question by the applicants, that, although, in the context of that trial, the applicants indeed claimed that the citalopram produced by Matrix infringed the crystallisation patent, this was again their subjective assessment, since that allegation was never confirmed by the court adjudicating on the case, the applicants having preferred to reach a settlement with Lagap in order to avoid a defeat which, in their own words, would have been ‘humiliating’ and would have been ‘used against [them] in other jurisdictions’ (recital 160 of the contested decision).EurLex-2 EurLex-2
